By accessing or using the Aqaris platform, website, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
If you do not agree to these Terms, you may not access or use the Service. Continued use of the Service after any changes to these Terms constitutes acceptance of the revised Terms.
Aqaris provides a cloud-based property management platform designed for property managers, community management companies (CMCs), owners' associations, developers, landlords, and other real estate professionals operating in the United Arab Emirates and the broader GCC region (the "Platform").
The Platform includes features for lease and tenancy management, service charge administration (including Mollak compliance), accounting and financial reporting, maintenance management, owner and resident portals, and related services. The specific features available to you depend on your subscription plan.
Aqaris is a pre-launch product currently in active development. Features, interfaces, and availability may change. We will communicate material changes in advance where reasonably practicable.

You must create an account to access most features of the Service. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at hello@aqaris.ae if you suspect any unauthorised access to your account. Aqaris is not liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure.
We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are associated with fraudulent activity.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
The Aqaris Platform, including its software, design, user interface, brand, trademarks, logos, and all content created by Aqaris, is owned by Aqaris and its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.
You retain ownership of all data and content you upload or create within the Platform ("Customer Data"). By uploading Customer Data, you grant Aqaris a limited, non-exclusive licence to process, store, and display that data solely to provide the Service to you. We do not sell, share, or use Customer Data for purposes other than operating and improving the Service.
The Service integrates with or relies on certain third-party services, including:
Your use of third-party services is subject to those services' own terms and privacy policies. Aqaris is not responsible for the conduct of third-party service providers, except to the extent of our contractual obligations to you.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
You are responsible for ensuring that any personal data you upload about tenants, owners, or other third parties is collected and processed in accordance with applicable data protection laws, including UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection.
Access to certain features of the Service requires a paid subscription. Fees are described on our Pricing page and are stated in UAE Dirhams (AED) exclusive of VAT. VAT is charged in accordance with UAE Federal Tax Authority requirements where applicable.
Subscription fees are billed in advance on a monthly or annual basis according to your selected plan. Failure to pay fees may result in suspension of access. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AQARIS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
As a pre-launch product, the Service is under active development. Certain features described on this website may not yet be available. We make reasonable efforts to ensure accuracy of all descriptions and feature listings, but do not guarantee that all stated features are currently operational.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AQARIS AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL AQARIS'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO AQARIS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) AED 1,000.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.
These Terms are governed by and construed in accordance with the laws of the UAE and the emirate of Dubai, without regard to conflict of law principles. The courts of Dubai, UAE shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or your use of the Service, unless otherwise agreed in writing.
Before initiating any formal legal proceeding, you agree to first contact us at legal@aqaris.com to attempt to resolve the dispute informally. We will make reasonable efforts to resolve the matter within 30 days of receiving your written notice.
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email or prominent in-platform notification before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those changes.
If you do not agree to revised Terms, you may terminate your account before the changes take effect. The "Last updated" date at the top of this page reflects the most recent revision.
You may terminate your account at any time by contacting hello@aqaris.ae. Aqaris may suspend or terminate your access immediately, without prior notice, if you materially breach these Terms.
Upon termination, your right to access the Service ceases. You will have 60 days following termination to export your Customer Data, after which it will be deleted in accordance with our Privacy Policy.
